8.) Restrictions on the Use of the Site. Mugg&Bopps reserves the right to pursue any and all civil and criminal remedies available for any breach of the restrictions contained herein.
9.) User Postings and Links. Mugg&Bopps does not and cannot review all material posted to the Site by users, and Mugg&Bopps is not responsible for any materials posted by users. Mugg&Bopps has not reviewed all of the sites which are linked to the Site, and the fact of such links does not indicate any approval or endorsement of any material contained on any linked site. Mugg&Bopps is not responsible for the contents of any site linked to the Mugg&Bopps Site. Your connection to and use of any such linked site is at Your own risk.
10.) Indemnification for Your Breach of Agreement. You hereby agree to indemnify, defend and hold Mugg&Bopps and all its officers, directors, owners, agents, employees, information providers, licensors and licensees (collectively the “Indemnified Parties”) harmless from and against all liabilities and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by You of the Agreement. You shall cooperate as fully as reasonably required in the defense of any claim. Mugg&Bopps reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by You, and You shall not in any event settle any matter without the written consent of Mugg&Bopps.
11.) No Warranty. The Site, including all content, materials and information made available to You or accessed by You through the Website is provided “as is.” To the fullest extent permissible by law, Mugg&Bopps makes no representation or warranties of any kind whatsoever for the content on the Site, the materials, information and functions made accessible through the Site. Mugg&Bopps makes no representation or warranties of any kind whatsoever for any products or services or hypertext links to third parties or for any breach of security associated with the transmission of sensitive information through the Site or any linked site. Further, Mugg&Bopps disclaims any express or implied warranties, including, without limitation, non-infringement, merchantability or fitness for a particular purpose. Mugg&Bopps assumes no responsibility and shall not be liable for any damages by use of the Mugg&Bopps Site. 14.) Governing Law and Venue. The Agreement and the rights, duties, and obligations arising under this Agreement, shall be interpreted and construed in accordance with the laws of the State of Michigan. The venue for any action under this Agreement shall be in the State of Michigan, whether such venue is or subsequently becomes inconvenient, and the party’s consent to the jurisdiction of the courts of the State of Michigan, County of Livingston, and the U.S. District Court, Eastern District of Michigan.
15.) Termination. Mugg&Bopps reserves the right to deny use of all or part of the Site to any user for any reason without notification. Mugg&Bopps may, in its sole discretions and at any time, modify or terminate the Site and remove or refuse to post any information, content, or materials.
